The Day America Died?

One thing is certain: China’s Communist rulers in Beijing are celebrating. 

Their economy was “sputtering” at best, until they launched the deadly Coronavirus (or COVID-19)—as a bioweapon or inadvertently—which has decimated the United States and other countries globally.[2]  Donald Trump was determined to hold them accountable, but now he is departing from the world’s stage, or so it would seem.  And in his place are “Brain Dead” Joe Biden, who suffers from advancing Dementia after at least two brain operations[3]; Willie Brown’s ho Kamala Harris[4]; Chuck Schumer and Nancy Pelosi; and others of their ilk.

America’s Left is vicious; and it is determined to erase the legacy and all vestiges of Trump and his presidency.  It has attacked him endlessly since his quest for the White House began, which will continue.  Because the Republican Party is effectively “dead,” there will be little or no opposition—or resistance.   And Trump’s legions of loyal supporters, who turned out nationwide in the worst of weather conditions, may be cowed into believing that somehow they are the problem.

The thugs, slugs, hoods and mongrels of “Black Lives Matter,” Antifa and other far-Left groups—which burned our cities, killed or hurt innocent Americans including our police, and destroyed black and other businesses—may become the victors, which is the world turned upside down.  It is tantamount to the Pigs in George Orwell’s prescient “Animal Farm” becoming the victors, and subjugating the other animals.[5]  America’s Left is anti-police and anti-military, and it will attempt to gut both.

How will the Democrats reverse the course of our great republic? A few examples will suffice. In all likelihood, they will (1) legalize even more drugs, nationally; (2) legalize the illegal immigrants in our country already, and give them a path to citizenship; (3) open our borders wide, with few if any impediments to entry, certainly at our southern border; (4) destroy our energy independence by embracing the hoax of man-made “global warming,” thereby making us dependent on Middle East oil again, in whole or in part, and destroying American jobs[6]; (5) open the floodgates wide to abortions and Infanticide, which have killed ten times the number of those who died in the Holocaust, since Roe v. Wade[7]; (6) implement unconstitutional gun control; (7) attempt to “pack” the Supreme Court; (8) curtail and/or criminalize free speech; (9) seek reparations for slavery, which the Democrats instituted and perpetuated in America; (10) continue to erase our history, and tear down or deface monuments[8]; and (11) cut deals with China, which will insure that nation’s global dominance in the years ahead.

Perhaps the overriding—and underlying—theme in the United States and China today is Godlessness.  Where is God in the midst of all this chaos?[9]  Aside from the deadly virus that is creating so many deaths and so much suffering around the world, China has been (1) snuffing out the fledgling democracy in Hong Kong; (2) enslaving/”reeducating” the Uyghurs and other ethnic groups that number at least 1 million; (3) threatening Taiwan and our other allies; (4) waging the savage border war with India, where they just “fried” Indian soldiers with a new EMP weapon, which might be used globally; and (5) seeking global domination.[10]

It is useful to pause and put the Trump presidency into perspective.  There was and is only one Abraham Lincoln, who saved our great nation and ended slavery.  Similarly, there was and is only one Ronald Reagan who survived an assassin’s bullet and brought down the Soviet Union without a shot being fired.  The same thing is true of Donald Trump who survived China’s Coronavirus, as well as more than four years of the “evil” Left’s efforts to destroy his candidacy and his presidency.  Much of this was orchestrated by the un-American racist and anti-Semite Barack Obama and his co-conspirators, who committed treason.[11]

The Democrats continued to perpetuate slavery after our last Civil War ended—in the form of the KKK, segregation and later LBJ’s “Great Society” programs, which destroyed black families and consigned them to economic servitude.  Donald Trump has done the opposite by helping minorities of all colors, religions and ethnic backgrounds; and his popularity has reflected this.  Thus, he has been a threat to America’s “establishment,” both Democrats and Republicans alike.

He is the consummate “outsider,” who is beholden to neither political party, and is justifiably contemptuous of both.  His very existence has evoked unbridled hatred by Democrats and RINOs alike, such as the despicable Utah Senator, carpetbagger and failed presidential candidate, Mitt Romney.  Jealousy is not an insignificant factor—and our Supreme Court has betrayed the American people in the process[12].

As 2020 drew to a close, many Americans were thankful that they survived one of the worst years in their lives.  Many of us know people who have died, or have been at “death’s door” before recovering.  Yet, there are reasons to believe that the virus is mutating, and that it may be even more devastating in 2021 and beyond, notwithstanding the presence of one or more vaccines.[13] 

If the 2020 election results were not an outgrowth of such craziness, they were certainly consistent with it—and both Orwellian and surreal.[14]  Our nation is in peril, as the Godless forces of pure evil are on the verge of taking over, which George Orwell warned about.

2020 Annus Horribilis

As 2020 draws to a close, many Americans will be thankful that they have survived the Annus Horribilis[2], or the “horrible year” of 2020, one of the worst years in their lives.  China launched its deadly Coronavirus (or COVID-19), which has decimated the United States and other countries globally.[3]  Many of us know people who have died, or have been at “death’s door” before recovering.  Yet, there are reasons to believe that the virus is mutating, and that it may be even more devastating in 2021 and beyond, notwithstanding the presence of one or more vaccines.[4] 

Pat Buchanan—an adviser to Presidents Richard Nixon, Ronald Reagan and Gerald Ford, and a former GOP presidential aspirant himself—has discussed the schisms in America today, in an article entitled “Can Democracy Hold Us Together?”:

If America were a company and not a country, we would have long ago dissolved the corporation, split the blanket, and gone our separate ways.

What still holds this disputatious and divided people together?

Consider. In announcing the $900 billion stimulus bill to deal with the pandemic, Speaker Nancy Pelosi did not mention that the gifts for her distressed countrymen and women at Christmas would have been twice as large had she taken President Trump’s offer of $1.8 trillion in October.

Why did the speaker slap that offer away?

“The President only wants his name on a check to go out before Election Day and for the market to go up,” she told House Democrats.

Rather than let Donald Trump take credit, Pelosi stiffed millions of Americans.

Sunday, however, the speaker took time for a statement to hail the removal of Robert E. Lee’s statue from Statuary Hall. “Welcome news,” said the speaker. “Congress will continue our work to rid the Capitol of homages to hate.”

Lee had stood in a place of honor in the Capitol for decades. When exactly did the statue of the general become a homage to hate?

Both episodes point up an unpleasant truth.

Our dysfunctional American family agrees upon less and less.

By mid-November, according to a Reuters/Ipsos poll, 52% of Republicans thought Donald Trump had “rightfully won.” Sixty-eight percent of Republicans thought the election was “rigged.” A third of independents, and even 10% of Democrats, agreed.

This month, a Fox poll found that a third of all registered voters believe the 2020 election was stolen from Trump, with 78% of those who voted for Trump expressing that view.

In the long term, not only is the election of 2020 going to be suspect. Also, belief in one of the sacraments of secular democracy, universal suffrage, is going to suffer.

Moreover, the issues that divide us now go increasingly to the faith of what defines us as a nation and a people.

A slice of our intellectual elite emphatically agrees with the New York Times’ Project 1619, which decrees that the real birth date of this nation was neither 1776 nor 1789, but the year that the first slave ship arrived in Virginia.

To this influential cohort, enslavement of Black people brought from Africa and dispossession and destruction of the indigenous tribes that European settlers found here are the defining events of our history.

And all who participated in these crimes against humanity or refused to condemn them are undeserving of exaltation.

Not only Lee, but Columbus and Presidents Washington, Jefferson, Madison, Jackson, TR and Wilson are all racist white men whose disgraceful and even criminal conduct disqualifies them from a place of honor in the American pantheon of 2020. All statues of such men need to come down to cleanse us of the stain of having honored them.

Pelosi says that such statues are “homages to hate.”

She may not have thought so five or 10 years ago, but she believes that now.

What has taken place is a mass conversion.

Yet, there is another America that still cherishes the nation these men created. And, as did their fathers, grandfathers and ancestors, these Americans have shown a willingness to fight and die in her defense.

Thus do we Americans disagree on the most fundamental of issues.

Was America, is America, with all its sins and virtues and all its achievements, a country to be cherished, loved and defended? Or is America a country of whose history we should all be ashamed?

Part of America also believes that discovery in the Constitution of a woman’s right to an abortion and a right of homosexuals to marry were major milestones of progress toward a more moral America.

Others see these as long strides away from the Christian country we used to be, a social and moral decline toward the same quiet death that has come to other civilizations and nations that went before us.

In short, we Americans disagree on whether our country is a good and great nation worth defending, or a place that needs a deep cultural cleansing of its sins.

And we have no common code of morality. One side is rooted in modernism and secularism and the other in the teachings of the Old and New Testament, Christian tradition and a natural law written on the human heart that is superior to man-made law.

People who disagree upon such basic beliefs naturally drift apart, as we Americans are doing today.

Political questions arise out of these fundamental differences, and they are not insignificant.

Can a republic as fractured and splintered as ours is — racially, ethnically, politically, culturally, morally — with a population who do not share the same belief about whether their nation is good and great or failed and evil, endure? And for how long?

What successful models from history do we see of nations that took the kind of risks we are taking with our republic?[5]

The only successful models in American history are our Revolution and our Civil War, both of which resulted in enormous carnage.[6]

The High-Tech Lynching Of Donald Trump

There was never any hope that the three Democrats on our Supreme Court would seek truth and justice with respect to the 2020 elections, which thus far have stolen the presidency from Donald Trump and given it to Brain Dead Joe Biden and Willie Brown’s ho Kamala Harris.[2]  Similarly, there was never any hope with respect to the despicable John Roberts, the biggest mistake that George W. Bush made as President other than launching our great nation into the tragic Iraq War in which more than 5,000 Americans died and many more were maimed, and trillions of dollars were wasted, for nothing.

But after his “high-tech lynching” during the confirmation process, it was not unreasonable to believe that the Court’s only black Justice, Clarence Thomas, might do the right thing.  After all, under his leadership, there was potentially a 5-4 majority on the Court, consisting of Thomas, Alito and the three Trump appointees—Gorsuch, Kavanaugh and Barrett.  Instead, the criminal Justices disenfranchised 74 million Trump voters[3], and made the un-American racist and anti-Semite Barack Obama proud[4].

He spent more than four years orchestrating efforts to destroy the candidacy and presidency of Donald Trump; and finally, instead of spending the rest of his life in prison for treason, he seems to have been vindicated.  His Vice President is expected to ascend to the presidency, even though Biden’s Dementia is advancing and becoming obvious to the world, and certainly to our enemies.

Thomas has brought shame to himself, his family and the Court, which was wallowing in and riddled with shame and criminality already.  After all, it has blessed infanticide and been a co-conspirator in the deaths of far more than 55 million American babies since the Court’s decision in Roe v. Wade—which exceeds the number of those who were killed in Hitler’s Nazi Holocaust, Stalin’s Soviet Holocaust and Mao’s Chinese Holocaust.[5]

In the final analysis, Thomas might have become a historically-important, de facto “Chief Justice.” Instead, he has given credence to the allegations against him by Anita Hill during his confirmation process, and ingratiated himself with the traitor Obama.  What a coward, at the very least.

As I have written previously:

None of the 74 million Americans who voted for our great President should ever trust the Court or our judicial system again. We live in a nation that is lawless, and no better than Russia, China, North Korea and other totalitarian systems.

George Orwell was correct when he wrote his prescient “Animal Farm” about the Pigs.  All of the animals were equal until the Pigs reigned supreme and subjugated the other animals.  We are inches away from this happening; and the Supreme Court just dealt a fatal blow to free elections and American justice.

They no longer exist.  They are dead and buried.  And let history record that it happened in Washington, D.C., the modern-day equivalent of Sodom and Gomorrah.[6]

Thomas and each of the other so-called “Justices” must be hounded for the rest of their lives, at the very least.  Nothing less will suffice.

The U.S. Supreme Court Must Be Destroyed As A Governmental Entity

Our Supreme Court has rejected the Texas Attorney General’s bid to overturn Joe Biden’s presumptive election victory, in a defeat for our great President, with his three cowardly and despicable appointees to the Court voting against him.[2]

The Supreme Court must be destroyed as a governmental entity.  It has outlived its usefulness, and no longer serves the American people.  Abraham Lincoln took a similar approach during our last Civil War, when he ignored a decision by Chief Justice Roger Taney.[3]  Now we must go farther.

It is unconscionable that the three Trump appointees to the Court—Justices Gorsuch, Kavanaugh and Barrett—did not see fit to join Justices Thomas and Alito; and that the latter two Justices signaled that they would not overturn the rigged election results.

None of the 74 million Americans who voted for our great President should ever trust the Court or our judicial system again. We live in a nation that is lawless, and no better than Russia, China, North Korea and other totalitarian systems.

George Orwell was correct when he wrote his prescient “Animal Farm” about the Pigs.[4]  All of the animals were equal until the Pigs reigned supreme and subjugated the other animals.  We are inches away from this happening; and the Supreme Court just dealt a fatal blow to free elections and American justice.

They no longer exist.  They are dead and buried.  And let history record that it happened in Washington, D.C., the modern-day equivalent of Sodom and Gomorrah.[5]

There are reasons to believe that Joe Biden suffers from Dementia, which is progressing.[6]. These are scary times for so many Americans, who have been dying or hurt by China’s Coronavirus (COVID-19).[7].  And our once-admired Supreme Court has turned its back on history, and does not deserve to exist any longer.

Will Kavanaugh Prove Disastrous For The Democrats?

The confirmation of Brett Kavanaugh as the newest Justice of the U.S. Supreme Court has sent shock waves through America[2]; and its effects may be most pronounced for the Democrats—who lost.  And yes, lots of us began as Democrats, but will never vote for one again.

Something similar may be true of the Left’s stalwarts who demonstrated across this country, first for Bernie Sander’s candidacy as the Democrats’ nominee for president in 2016—which was co-opted and “buried” by Hillary Clinton and her thugs—and then to defeat Kavanaugh’s confirmation.  They may feel that they were cheated and sold down the river by the Democrats, who failed to deliver . . . again.

The wind may go out of their sails, while the Republicans—and especially the Trump “faithful”—may be energized almost like never before.  “How sweet it is” (they may say or think) that their efforts proved successful, as they did in the 2016 election.  With the U.S. economy seemingly purring along[3], they may be convinced of their righteousness and of the certitude of their actions, which may propel them on to other and even greater victories.

In retrospect, Kavanaugh may have been a flawed candidate, and perhaps even more of a flawed Justice.[4]  What his elevation to the Court may mean—along with Neil Gorsuch before him, and soon the feeble Ruth Bader Ginsburg’s replacement—is that Donald Trump’s political and legal flanks will be protected against the Democrats’ efforts to remove him from the presidency.  If so, then the elevation of a flawed Kavanaugh to the Court will have served its purpose and satisfied Trump’s faithful.[5]

Aside from possibly defusing the Left’s zeal, the Kavanaugh confirmation fight has exposed its underbelly for all Americans to see.  Dianne Feinstein of California was shown to be an ineffectual, lying senator, who had kept a Chinese spy on her staff for approximately 20 years, despite the fact that she was entrusted with the nation’s most sensitive secrets.[6]  Richard Blumenthal from Connecticut was tarnished again for lying about his military service in Vietnam[7]; and the list goes on and on[8].

The Kavanaugh fight may have served another purpose.  It seems to have strengthened the spine of weak-kneed and often pathetic Republican “Neanderthals.”  They rose to the occasion and defeated the onslaught of the Democrats’ lies and normally-astute political skulduggery, which had been so successful in the past.  The departure of the totally-inept and ineffectual Paul Ryan from the House of Representatives may further this progression.[9]

America’s Newest Civil War: 2017 And Beyond

President Trump was elected by the American people.  There are a myriad of persuasive arguments why his opponent, Hillary Clinton, should be indicted, convicted and imprisoned for the rest of her life.[3]  Yet, the drumbeat among Democrats, so-called “progressives” and the far-Left is to destroy the Trump presidency before it has begun.[4]

Many Americans felt just as strongly about the black racist Barack Obama[5], but they did not try to destroy his presidency or advocate his assassination as many in the anti-Trump camp have.  Their seditious, subversive and treasonous conduct strongly suggests that they pose a danger to our system of government. They should be arrested, tried, convicted and imprisoned.

Pat Buchanan—an adviser to Presidents Richard Nixon, Ronald Reagan and Gerald Ford, and a former GOP presidential aspirant himself—has written:

Trump is hated by [Washington, D.C.], which gave him 4 percent of its votes, as much as Nixon was. And the deep-state determination to bring him down is as great as it was with Nixon. By 1968, the liberal establishment had lost the mandate it had held since 1933, but not lost its ability to wound and kill [Republican] presidents. Though Nixon won 49 states, that establishment took him down. Though Ronald Reagan won 49 states, that establishment almost took him down in the Iran-Contra affair. And that is the end they have in mind for President Trump.[6]

The United States and the American people are facing threats to our existence, which are unprecedented in our history, far surpassing 9/11 and Pearl Harbor.[7]  We cannot permit the seditious, subversive and treasonous conduct of some to pose a danger to our system of government and way of life.

The American Legal System Is Broken: Can It Be Fixed?

I have been an American lawyer for 44 years.  I am a member of the bar of the United States Supreme Court, the District of Columbia Bar, the State Bar of California, and the bars of other federal courts.  I have been a U.S. Senate lawyer and a lawyer at the Pentagon, and have represented more than 200 banks and other financial institutions.  I have purchased banks for our clients, and advised two States; and I testified as an expert on behalf of the FDIC in a failing bank case.  I have done essentially everything that I ever wanted to do in the law, except work at the White House; and I have attended meetings there.  In these and countless other ways, I have seen the American legal system “up close and personal.”[3]

I have two law degrees, from Berkeley and Georgetown, at opposite ends of this great country.[4] I can say without any hesitation, reservation or equivocation that the finest education I received was at Berkeley’s law school par excellence, Boalt Hall.  I was taught—to think analytically, and to write—by outstanding professors[5] who instilled in my fellow students and me a belief that the law is sacred, sacrosanct and pristine, “a shining city upon a hill.”  Since then whenever I have encountered what I perceived as legal injustices and incompetence, I have taken umbrage and railed against them, albeit generally in my own quiet ways.

John Lennon probably said it best: “Life is what happens to you while you’re busy making other plans.”  I never truly wanted to become a lawyer; that was not my life’s ambition.  I wanted to be a businessman instead, and buy and sell companies, but the Vietnam War intervened and changed my life forever.[6] I never dreamed of being a lawyer, like so many of my law school classmates at Berkeley did, which may explain why I view the profession—which so many Americans have come to despise—with a certain degree of detachment and healthy skepticism.  For example, I would not recommend the practice of law to anyone.  Among other things, the time demands and stress on young lawyers are a “family-killer,” which is why there is a high rate of divorces among members of the profession.

When my son wanted to attend law school, I encouraged him to get both a JD and an MBA, to “hedge his bets” and give him options.  When he was nearing graduation with both degrees in hand, I did my best to talk him out of practicing law.[7] Friends of mine, who have practiced law for many years and have been very successful at doing it, feel much the same way and have told their kids and others not to pursue a legal career.  Indeed, some of these friends and I have joked that we should give lectures to graduating college seniors and entering law school students, telling them what the practice of law is really all about.  If we told them the unvarnished truth, many might decide not to enter the profession.

Despite a healthy contempt for many lawyers, and judges—who are often egotistical, callous, mean-spirited, power-hungry, arrogant, self-righteous, condescending and incompetent—I have had wonderful friends over the years who are lawyers and even judges.  I have worked with them, and some have represented me, and I will always respect and be deeply indebted to them.  They are special people, who stand head-and-shoulders above others in the profession; and they are nice people as well—which may be what distinguishes them from the others.

Perhaps the most disturbing qualities about lawyers and judges are their arrogance and abuse of power, and their lack of empathy and innate legal and life skills to deal with vital human issues that come before them.  For example, lawyers who are prosecutors are often less interested in fairness and justice than they are in winning at all costs, and exercising their raw power and hurting others in the process—such as those who are innocent but are convicted anyway.[8]

Similarly, lawyers are trained in law schools to be advocates.  When they represent clients in divorce proceedings, the last things that estranged couples need are their respective lawyers “stirring the pot” to earn greater fees, and increasing the acrimony that already exists.  Also, male lawyers prey sexually on their distraught and vulnerable female clients, which should give rise to immediate disbarments but it does not.  The American legal system is broken today, inter alia, because it has often attracted the wrong type of people.[9]

Can our legal system be fixed, and will the American people come to trust and respect lawyers and judges again, and believe that justice not only exists but prevails in this great nation?  Maybe . . . if the profession is restructured, and if it attracts those people who believe that the law is sacred, sacrosanct and pristine—truly a shining city upon a hill—and they put such principles into practice.  The profession does not require saints, but it does need something different than “Law West of the Pecos by Judge Roy Bean.”  And it needs people who are different than it has been attracting: who are often driven, ruthless, unprincipled, money-hungry, and power-hungry.

[6] As a result of enrolling in Army ROTC as an undergraduate, I had a commission as an officer when I graduated from UCLA in January of 1963.  I wanted to attend a business school; however, I needed to work from January to September at two jobs, to earn enough money so I could afford any graduate school.  Even though UCLA’s business school had classes that I could begin right away, in January—whereas, law school classes only began in September—my choice became a law school.  The Vietnam War was raging; and the Army would defer me for law school, but would not let me work for the same amount of time before entering a business school, which is the graduate education that I really wanted to pursue.

Having become a lawyer, however, I have always tried to do my very best, and believe that I have done so.  Also, reading endless legal decisions at Boalt Hall and later at Georgetown, I learned the English language in ways that were unfathomable at the time, but have proved to be quintessentially-invaluable with respect to any skills that I have today as a writer.

The great American poet, Robert Frost, wrote a wonderful poem about life choices entitled, “The Road Not Taken,” which perhaps says it all:

Two roads diverged in a yellow wood,
And sorry I could not travel both
And be one traveler, long I stood
And looked down one as far as I could
To where it bent in the undergrowth;

Then took the other, as just as fair,
And having perhaps the better claim,
Because it was grassy and wanted wear;
Though as for that the passing there
Had worn them really about the same,

And both that morning equally lay
In leaves no step had trodden black.
Oh, I kept the first for another day!
Yet knowing how way leads on to way,
I doubted if I should ever come back.

I shall be telling this with a sigh
Somewhere ages and ages hence:
Two roads diverged in a wood, and I—
I took the one less traveled by,
And that has made all the difference.

[8] A federal official with reason to know told me that between 15-20 percent of the indictees in federal courts are probably innocent.  Some are seniors who have been charged with cheating the Social Security program, and they are scared to death, so they agree to plea bargains rather than fight for their innocence.

[9] This is true of many judges, who serve for life and cannot be removed if they are federal judges.
